Bleaklow loses enforcement notice appeal

The latest scene in the long running soap opera known as quarrying in the Longstone Edge area of the Peak District National Park has ended with landowner Bleaklow and operator MMC Minerals losing an appeal against an enforcement notice placed on Wagers Flat in May last year.

Inspector Graham Self said: “The points mentioned do not make it impossible for a reasonable operator...to understand with reasonable certainty the related allegation and requirements of the enforcement notice.”

The decision means that there is now a good chance of an eight-day public inquiry in May assessing the extracton of limestone at the site.

Meanwhile, both parties are preparing for another expensive event: a High Court appeal against the planning inspector’s decision last year to uphold an enforcement notice on the Backdale operation (see MQR passim).

Scheduled to take place 27-29 February, the appeal will see the parties questioning the inspector’s decision to slap a ruling of limestone needing to be won “secondary and subordinate” to fluorspar at a ratio of two tonnes of limestone to every one tonne of fluorspar.
