HSE prosecution

Mold-based DP Williams Holdings Ltd prosecuted for continued non-compliance with legislation

NORTH Wales-based quarrying firm DP Williams Holdings Ltd have been fined for putting employees, contractors and delivery drivers at risk, having pleaded guilty to continued non-compliance with relevant legislation, despite being warned previously by the Health and Safety Executive (HSE).

The specialist quarrying company appeared at Wrexham Magistrates’ Court and was fined £5,000 with costs of £2,500 after admitting to breaches of the Provision and Use of Work Equipment Regulations 1998 (PUWER), Reg. 11(1)(a); and The Quarries regulations 1999, Reg. 30 (a&b).

The court heard though no one had been injured, the firm had been issued with two Prohibition Notices and four Improvement Notices by HSE inspectors during the period December 2009 to September 2013 relating to dangerous working conditions at the quarry.

The court also heard the company had previously ignored advice from its own quarry manager and geotechnical specialist about working conditions at the quarry.
